USER AGREEMENT

ARTICLE 1 - Introduction
This user agreement and other rules on the Website regulate the terms and conditions of the services offered by UNITED STATES TECHNICIANS ASSOCIATION INC and the rules regarding the use of the Website. ARTICLE 2 – DEFINITIONS:
Within the text of this Agreement;
a) e-usta UNITED STATES TECHNICIANS ASSOCIATION INC Company,

c) “User” means people who use the Website for any reason.
d) "Member" means the User who sets a password for himself/herself, subject to the acceptance of this User Agreement by registering an e-mail,
e) "Service Recipient" refers to the natural or legal person User who submits a Service Request via the Website,
f) “Service Provider” is the taxpayer individual, organization or legal entity who creates a Professional Profile on the Website to provide the Service and approves this user agreement (if the Service Provider is a legal entity, this definition refers to the person who carries out the services on behalf of the Service Provider and works under him/her). ARTICLE 3 – SERVICES OFFERED BY e-usta
e-usta ensures that the service, product, goods or service request information, the content of which the Service Provider and the Service Receiver create themselves, are included on the Website in accordance with the content notified to it and within the framework of the provisions of this Agreement. e-usta . It is only a platform, it does not control the content of the services on the Website and is not the owner or provider of these services. The service recipient and service provider are responsible, and do not mediate any employee-employer relationship.
ARTICLE 4 – TERMS OF USE
Membership System
• Membership to the Website is free. Members may submit multiple Service Requests simultaneously through a single Member account. It is the user's own responsibility to determine and protect the password. Username and password should not be shared and should be carefully protected. The member is directly responsible for the malicious use of his account by other persons due to his own fault. e-usta has the right of recourse to the Member for any judicial/administrative fines and/or compensation that it may have to pay for this reason.
All information declared to the Website when creating a member account, such as name, address, telephone, e-mail, tax office, must be up-to-date, accurate and complete. e-usta is not obliged to check the accuracy and currency of the information in question. Responsibility for any damages incurred by Members or third parties due to incorrect or incomplete information in question belongs to the relevant Member.

Creating a Service Request
• Any User who is at least 18 years old and has the power to appeal may create a Service Request by accurately and completely filling in the information requested in the registration form in accordance with the terms of this Agreement.
• In order to create a valid Service Request, the necessary information regarding the service (nature, feature, quality, dimensions, place of performance and delivery and duration of the work, etc.) must be provided completely, accurately and clearly, and its content must comply with the conditions specified in this Agreement. must.
• e-usta publishes the Service Request if it deems it appropriate after reviewing it. However, all responsibility for the content of the Service Request belongs to the Service Receiver.
Reservation System
• e-usta provides a reservation system that provides regular or one-time referral to the Service Provider for some services, depending on their nature, at an appropriate standard tariff on the days and hours to be determined by the Service Receiver.
• For services subject to the reservation system, the Service Receiver confirms the Service Request by making the relevant payment. The Service Receiver can view the Service Provider details directed to him/her one day before the reservation date[1] on the request detail page. If the Service Receiver does not accept the Service Provider directed to him/her, he/she requests the Service Provider to be changed by sending an e-mail to support@e-usta.net before the day the service will be provided. Otherwise, the Service Provider is deemed to have been accepted.
Reservation System Change and Cancellation Rules
• The Service Receiver can change the day or time or cancel the approved Service Request by sending an e-mail to support@e-usta.net up to 24 hours before the reservation time.
• Job cancellation must be made through the communication channels notified on the Website and cannot be made outside of the Website.
Creating a Professional Profile
• Any User who is at least 18 years old and has the power to appeal can fill in the information requested in the registration form accurately and completely, and after approving the terms of this Agreement and the Member Service Agreement, create a Professional Profile in accordance with the accepted conditions and content and gain the title of Service Provider.
• To create a Professional Profile, the information requested at the time of registration, such as name, brand, title, contact information, tax office, tax number, must be provided completely and clearly. Documents and references such as additional documents, licences, licenses, driver's licenses, diplomas, service authorization certificates, trade registry certificates, chamber registrations, etc. must also be entered to prove that they have the necessary license (if any) and qualifications, experience and ability to provide services related to the Professional Profile.
• The terms and conditions regarding the Service Provider and the obligations of the Service Provider are stated in detail in the Member Service Provider Agreement, which must be approved before creating a profile. • Offer submission, if accepted by the Service User, means making a binding legal agreement with the Service User to provide the service at the price specified in the Offer. The prices given in the Offer may change upon the Service Provider's discovery of the relevant work; in such cases, the Offer price is updated by agreement between the parties. It is assumed that the Service Provider is a taxpayer and a trader, and delivery notes, invoices and similar documents are sent to the person or organization receiving the service.

• Except for the Reservation System, any changes regarding the service that is the subject of an approved Offer must be agreed upon jointly by the Service Provider and the Service Receiver on the Website. Professional Profile, Service Request and Content of Offers

Payment:
• Service Recipients can pay the price for the Offer they have accepted directly to the Service Provider after the service is performed, or they can make instant online payments via the Online Payment System, debit card, credit card or a similar payment instrument and other payment systems. In payments made using the payment option with the Online Payment System, if the card is used unlawfully by someone other than the holder, the transaction is carried out in accordance with the provisions of the Regulation on Debit Cards and Credit Cards.
• The Service Provider collects the order fees from the Service Receiver through the Offer submitted to e-usta in return for a receipt or invoice, except for those paid via the Online Payment System.
• In cases where e-usta is the intermediary of the payment institution cooperated with the Online Payment System; The relationship between the payment institution and the Service Recipient and Service Provider is independent of e-usta and the responsibility and fulfillment of the obligations stipulated in the relevant legislation belong to the relevant payment institution.
• When the Online Payment System is used, the service receipt/invoice or other documents required to be issued are issued by the relevant Service Provider, if there are regulatory obligations in accordance with the relevant legislation. Service Fee Refund/Exercising the Right of Withdrawal
• The Service Receiver has the right to withdraw from the contract within 14 days following the agreement with the Service Provider, without giving any reason and without paying any penalty, provided that the service has not been performed. This right is available in the Reservation System until 24 hours before the service start time. o Mandatory cancellation of the Service Request due to the Service Request not being forwarded to the relevant Service Provider;
o Cancellation of the Offer upon the User's request, even if the Service Provider does not fulfill the obligation or the Offer is approved by the Service Receiver;
o Partial or complete compulsory cancellation of the service due to incompatibility of the service scope with the Offer;
o Cancellation of approval following receipt of approval from the relevant Service Provider due to dissatisfaction with the service provided; And
o It will be carried out in case the performance of the approved service is delayed.

Service Liability, No Warranty and Independence of Relationship

However, this does not constitute an endorsement or warranty by e-usta.
• e-usta is not responsible for the relationship between the Service Provider and the Service Receiver, and ...e-usta .. has no responsibility for any damages that the Service Provider may cause to the Service Receiver or third parties during the service it will provide or at any time.
• In the e-usta Reservation System, it only directs the Service Provider profiles that are suitable for the Service Recipients among the Professional Profiles registered in the system, based on the availability of the Service Providers. e-usta will only take due care to provide the services at the specified time and at the specified Fixed Price.
• e-usta .. makes no guarantee or commitment regarding the reliability of the Service Providers, that they are suitable and competent to provide the relevant service, that the services are provided or provided on time, that they are safe and error-free, that the results to be obtained from the use of the service are adequate or reliable, or that the service quality meets the expectations. • The parties are directly responsible for all taxes, duties, fees, payments and similar liabilities arising from service contracts to be made between the Service Provider and the Service Recipient... Obligations of the Service User

• Provides instructional information about illegal activities such as the production or purchase of illegal weapons, violating another's privacy, or providing or creating computer viruses;
• Requests passwords or personal identifying information from others for commercial or illegal purposes;
• Contains commercial activities and/or sales such as contests, sweepstakes, barter, advertising and pyramid schemes without our prior written consent;
• Recording, disseminating, misusing personal information of others,
• Violates the intellectual and industrial rights of third parties, such as trademarks and patents,
• Involves unfair trade practices and limits competition, and
• Violates national and/or local consumer protection laws.
DISPUTE RESOLUTION AND COMPETENT COURT
• This Agreement is subject to the laws of the Republic of Türkiye.
• The Parties shall first endeavor to resolve any disputes arising from the application and interpretation of this Agreement amicably among themselves. They accept and declare that New Jersey Courts and Enforcement Offices are exclusively authorized to resolve disputes that cannot be resolved amicably.
STORAGE OF INFORMATION AND EVIDENCE AGREEMENT
• e-usta . User information, offers, comments/evaluations, etc. registered in the system. stored for at least three (3) years.
• In case of any disputes arising from this Agreement, the Parties shall use e-usta .'s commercial books and records and e-usta. data stored in their systems are subject to any disputes.
They declare, accept and undertake that they will accept as evidence what is stated in the relevant laws.
VIOLATION AND TERMINATION OF THE AGREEMENT
• It is responsible for any damages that e-usta and third parties may suffer as a result of users' violation of the provisions of this Agreement. If e-usta detects that the Agreement has been violated, it may immediately unilaterally terminate this Agreement without prejudice to its rights of claim arising from this Agreement.
• The Parties may terminate this Agreement at any time. At the time of termination of the contract, the parties' receivables from each other are not affected.
ARTICLE 9 – ENFORCEMENT
This Agreement continues to be used on the Website and e-usta applies to Users. It will remain in force unless a new contract is presented by .
